High-Stakes Trademark Infringement Lawsuit

GRU Partner Derek Ulmer represents a large corporation in a matter that perfectly highlights the complex nature of international business in a post-tariff world. GRU client Otiima USA is defending itself in federal court from a lawsuit brought by a Portuguese manufacturer called Otiima Industries, S.A. After tariffs altered how American businesses can import products and materials, the Portuguese company was essentially cut off from doing business with its U.S. counterpart.

After the partnership ended in 2025, Otiima S.A. claimed the American company committed trademark violations, our client is fighting back against the accusations.The complaint accuses the American company of trademark infringement, unfair competition, false advertising, fraud, tortious interference, and breach of contract, citing unauthorized trademark filings, deceptive social media posts, falsified manufacturing claims, and misuse of customer deposits. The American company brought a counter-complaint for trademark infringement, unfair competition, false advertising, fraud, and tortious interference.Ultimately, this case arises out of U.S. businesses coping with a changing world, and how foreign companies are attempting to take advantage. Derek was sought out for his expertise in business litigation, and he’s quickly developing a unique understanding of the new nature of international operations.
